Terms of Service

1. Acceptance of Terms

By accessing or using Buildyr AI ("Service"), operated by Buildyr AI, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Buildyr AI provides an AI-powered software development platform that orchestrates autonomous agents — including Business Analyst, Architect, Developer, and QA agents — to assist engineering teams in producing software from requirements through deployment. The Service is provided on a subscription basis.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to keep it updated.

4. Beta Access

During the beta period, access to the Service may be granted by invitation only. Beta features are provided "as is" and may change, be discontinued, or contain errors. Feedback you provide during beta may be used by us without obligation or compensation.

5. Subscriptions and Payments

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). Payments are processed by Lemon Squeezy. By subscribing, you authorize Lemon Squeezy to charge your payment method on a recurring basis. Prices are subject to change with 30 days notice. Failure to pay may result in suspension or termination of your account.

6. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use the Service to develop a competing product or service.
• Introduce malware, harmful code, or unauthorized automated queries.
• Share account credentials or resell access without written permission.

7. Intellectual Property

The Service and its underlying technology remain the exclusive property of Buildyr AI, Inc. You retain ownership of any code, content, or other output you create using the Service. You grant us a limited license to process your inputs solely to provide and improve the Service.

8. Confidentiality

We treat your source code and project data as confidential and will not disclose it to third parties except as required to operate the Service or as required by law. See our Privacy Policy for full details.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or uninterrupted. AI-generated output may contain errors — you are responsible for reviewing and validating all output before use in production systems.

10. Limitation of Liability

To the maximum extent permitted by law, Buildyr AI, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately for violations of these Terms. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination will do so.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Disputes shall be resolved exclusively in the courts of Delaware.
